Polish construction law divides building activity into three regulatory categories: works requiring a full building permit (pozwolenie na budowę), works requiring only prior notification (zgłoszenie robót budowlanych), and works that can proceed without either. The classification that applies to a specific renovation depends on the type of intervention, the classification of the building, and whether it falls under heritage protection.
The legal framework
The primary statute is the Construction Act (Ustawa – Prawo budowlane), most recently consolidated in Dz.U. 2023 poz. 682. It is supplemented by the Regulation on Technical Conditions for Buildings (Rozporządzenie w sprawie warunków technicznych, jakim powinny odpowiadać budynki), which sets the substantive standards for construction, insulation, fire safety and ventilation. Local spatial development plans (miejscowe plany zagospodarowania przestrzennego, MPZP) can add requirements beyond the national baseline.
From 2020, Poland implemented a series of amendments that simplified the permit/notification boundary for single-family residential buildings, but these simplifications apply only to new construction. Renovation of existing buildings, particularly those with heritage status, remains subject to a more detailed review process.
Works requiring a full building permit
A building permit is required for renovation or reconstruction works that:
- Change the external dimensions, volume or footprint of the building
- Remove or alter a load-bearing structural element (wall, column, beam, floor slab)
- Change the use of the building or a part of it (e.g., converting a commercial ground floor to residential use)
- Affect a building that is listed in the Register of Monuments (rejestr zabytków)
The permit application (wniosek o pozwolenie na budowę) is submitted to the local Powiat Architectural-Construction Administration (Starostwo Powiatowe / Wydział Architektury i Budownictwa). The authority has 65 days to issue a decision. The application must include a construction design (projekt budowlany) prepared and signed by a licensed architect or engineer.
Works proceeding on notification
Notification (zgłoszenie) is a lighter procedure: you notify the authority at least 21 days before work begins and may start unless the authority raises an objection within that period. Notification is used for:
- Roof replacement that does not change the pitch, height or shape of the roof
- Replacement of external cladding or render without structural changes
- Internal alterations that do not affect load-bearing elements or change the building's use
- Installation of a heating, ventilation or air-conditioning system
- Replacement of windows and doors (for standard residential buildings)
The notification must include a description of the planned works, their location, and in some cases a simplified drawing. For buildings in conservation protection zones (strefa ochrony konserwatorskiej) that are not themselves listed, the authority may require additional documentation of the building's current appearance.
Works requiring no permit or notification
Interior repair and maintenance work that does not alter structure, use or building installations generally requires no formal procedure. This includes replastering walls, replacing floor coverings, repainting, replacing sanitary fittings with equivalent products, and standard electrical repairs within an existing circuit. The practical test is whether the work changes anything structural, dimensional or functional.
Heritage-listed buildings
Buildings entered in the Register of Monuments (rejestr zabytków prowadzony przez Narodowy Instytut Dziedzictwa) require prior approval from the Voivodeship Monument Conservator (Wojewódzki Konserwator Zabytków, WKZ) for any work that might affect their character. This approval is separate from and precedes the building permit. The conservator may specify materials, colours, techniques and contractors. Any deviation from the approved method during construction requires a further application.
Buildings in a conservation protection zone (strefa ochrony konserwatorskiej) defined by an MPZP are not themselves listed but are subject to conditions set by the local plan. These conditions typically govern facade materials, window proportions, roof coverings and the colour of renders. Non-compliance is an administrative offence and can result in an order to restore the original appearance at the owner's expense.
The site manager (kierownik budowy)
For works requiring a building permit, the owner must appoint a licensed site manager (kierownik budowy) who takes legal responsibility for the execution of works in accordance with the approved design and construction law. The site manager maintains a construction log (dziennik budowy), which is the official record of all works carried out. The log must be maintained throughout the project and presented to the building authority on completion.
For notification-only works, a site manager is not legally required, but some owners appoint one voluntarily when the works are technically complex or when insurance requires it.
Completion and occupancy
On completion of works carried out under a building permit, the owner submits a completion notification (zawiadomienie o zakończeniu budowy) to the building authority. This is a declaration by the site manager that the works were completed in accordance with the approved design and that the building is ready for use. The authority has 14 days to raise any objection; if none is raised, the building can be occupied.
If the works resulted in a change to the building's area, volume or structural configuration, an as-built survey (inwentaryzacja powykonawcza) prepared by a licensed surveyor must accompany the completion notification. The survey updates the building's records in the cadastral database.
